Fivio Foreign is officially a free man.
The Brooklyn-born rapper, whose real name is Maxie Lee Ryles III, walked out of a New Jersey jail on August 1 after spending nearly seven months behind bars. The 35-year-old was sentenced to time served and placed on three years of probation after pleading guilty to third-degree terroristic threats stemming from a tense New Year’s Day confrontation.
The legal trouble began on January 1, 2025, in Edgewater, New Jersey, when a woman approached Fivio at an apartment complex asking for help jumpstarting her car. According to police reports, things escalated quickly — the rapper allegedly pulled out a gun and warned her,
“If I see you parked in front of this building again, there is going to be a f**ing problem.”*
Witnesses recognized the rapper and called 911. Surveillance footage from the complex backed up the woman’s story and ultimately became a key piece of evidence.
Fivio was arrested on January 18 and hit with multiple serious charges, including unlawful possession of a weapon and aggravated assault. Although no firearm was ever recovered, prosecutors moved forward based on the strength of the footage and eyewitness testimony.
Despite his legal team’s pushback — his attorney Adam Lustberg maintained early on that the case was shaky without a weapon — Fivio struck a plea deal in May. He was admitted to one count of making terroristic threats, and in return, prosecutors dropped the more serious weapons charges that could have landed him in prison for up to 20 years.
His sentence was finalized on August 1, a day earlier than scheduled. With 196 days already served, he was released and will now complete three years of probation, during which he must remain offense-free and pass regular drug tests.
This wasn’t the rapper’s first run-in with New Jersey law enforcement. In 2021, Fivio was arrested in Fort Lee on gun-related charges after reportedly fleeing police while carrying a loaded firearm.
Now back home, Fivio hasn’t wasted any time reconnecting with fans. He returned to social media within hours of release, tweeting lighthearted takes on the ever-evolving music scene.
“Damn lol… It’s a lot goin’ on outchea,”
He wrote.
In another tweet, he added,
“Y’all out here doing anything… I like it.”
He also showed off a flashy new chain in his Instagram account, hinting that he’s ready to reclaim his space in the New York drill scene — a genre that’s shifted in his absence with the rise of “sexy drill” and viral edits inspired by artists like Ice Spice.
Before his arrest, Fivio hadn’t dropped solo music since November 2024, though several collaborations recorded earlier were released while he was incarcerated. His final single before jail, “PlaqueBoyMax,” was a diss track aimed at a popular streamer following a social media spat over smoking in an Airbnb.
Fivio Foreign now faces the challenge of rebuilding his career while staying on the right side of the law. The rapper, known for hits like “Big Drip” and collaborations with stars such as Kanye West, must navigate his probation while reconnecting with a fanbase eager for new music.
