According to the indictment, Ding began secretly stealing confidential trade secrets from Google in 2022 and continued until his arrest in 2024. He allegedly downloaded thousands of files containing source code, design documents, and internal communications related to Google’s data center software.
The Motive: Conflicting Affiliations
While working at Google, Ding was secretly affiliated with two AI startup companies based in China. He even founded one of these companies, AI Spark Technology, in 2023. The company’s website claimed it was developing “cutting-edge AI solutions for various industries”.
Ding allegedly used his stolen trade secrets to benefit his company and the other Chinese AI startup, which was not named in the indictment. He supposedly went to China twice. Once in October 2022 and again in November 2023. It was for business meetings and a conference. He wanted to promote his company to potential investors.
The Arrest: Theft of Trade Secrets
Ding was arrested on March 6, 2024, at the San Francisco International Airport, as he was preparing to board a flight to China. He got indicted by a federal grand jury. They charged him with stealing trade secrets from Google. The theft involves AI technology information.
Each count carries a maximum sentence of 10 years in prison as well as a fine of $250,000. Ding pleaded not guilty to the charges and was released on a $500,000 bond. His trial is scheduled for June 2024.
